Application of Privacy and Cookie Statement

This Privacy and Cookie Statement explains how we, ZiuZ Holding B.V. (and all associated legal persons) hereafter ‘we’ or ‘ZiuZ’ handle your personal data when you visit one of the websites that we operate, including but not limited to https://www.ziuz.com, https://medical.ziuz.com and http://ziuzmedical.cn (hereafter: ‘websites’ or ‘our websites’).

 

Processing of personal data and the objectives

We process your personal data in the context of your visit to and/or use of our websites. ZiuZ processes your personal data with the objective of:

  1. making it possible for you to visit our websites, through use of essential and functional cookies, for example;
  2. identifying you when you contact us through the chat function on the websites, when you register for a ZiuZ challenge, for the newsletter and/or for a trial or when you use the job application form on the websites;
  3. further processing your application or registration for the topics listed under 2 and carrying out administration in this respect;
  4. sending you messages (including newsletters) – provided and insofar as you have registered for these – and/or otherwise contacting you in connection with the topics listed under 2;
  5. allowing the websites to function well through cookies, including the use of personal data for analytical objectives too.

 

Principles according to which we process your personal data

The processing of personal data for the above objectives is carried out on the basis of the following processing principles:

  1. The legitimate interests of ZiuZ in the processing of your personal data, which outweigh your privacy interests in the given circumstances (taking into account the impact of the processing on these). This processing principle applies for the following processing:
    • Processing of personal data that is required to be able to identify you and contact you in relation to a message you have sent, a job application form and/or a submitted registration form for challenges and trials. ZiuZ’ interest here is to be able to carry out its business activities and respond to your message in that context.
    • The processing of personal data (primarily through essential, functional and analytical cookies that have limited consequences for your privacy), which are necessary for the optimal functioning and operation of our websites. ZiuZ’ interest in this context is to offer our websites with the best possible functionality.
  2. The requirement for processing for the implementation of an agreement in which you are a party, or to take measures prior to the implementation of an agreement, at your request. This processing principle is applicable to the processing of your personal data in the context of a registration form submitted by you for the challenges and/or trials and/or a job application form submitted by you. If you do not provide us with this personal data, we may not be able to enter into an agreement with you in this context. Insofar as no agreement is entered into with you after processing of your registration form or job application form, the processing principle listed under 1 remains applicable in full.
  1. Your permission for the processing of your personal data in order to be able to send you a newsletter (and other commercial communication) and to be able to process cookies (other than functional and analytical cookies that have limited consequences for your privacy). You have the right to withdraw this permission at any time. This does not affect the legality of the processing of personal data on the basis of your permission prior to the withdrawal, however.

 

Storage period for personal data

ZiuZ will not store your personal data for longer than strictly necessary to achieve the objectives for which your personal data is collected, unless a differing legal storage period is applicable.

Recipients of your personal data

 

Internal

Only the ZiuZ employees who – in view of the processing objectives – need to have access to your personal data will receive access to this. In this context, this concerns the following categories of internal recipients:

  • IT Support Department
  • Marketing & Sales Department
  • HRM Department

 

External

ZiuZ only shares your personal data with third parties if this is necessary to achieve the objectives of the processing of your personal data. ZiuZ provides your personal data, insofar as necessary, to the following categories of external recipients:

  • the hosting provider of the website

 

Cookies

The ZiuZ websites use cookies and comparable technologies (for ease of reading, collectively referred to hereafter as ‘cookies’) to collect additional data about the use of the websites and improve services.

 

What are cookies?

Cookies are small files that are placed on your hard disk during a visit to the websites. Thanks to these cookies, you do not have to enter the same information or choose language settings again on a subsequent visit to the website and ZiuZ can improve the overall user experience of the websites.

Allowing cookies

ZiuZ always places functional and analytical cookies, which have limited consequences for your privacy. Other cookies – such as tracking cookies or cookies that have a major impact on your privacy interests – are only placed by ZiuZ if you have provided permission for this in advance. You provide your permission by clicking ‘Accept’ in the cookie notification on your first visit to the websites. This is not compulsory, however; you can use the websites even if you do not provide ZiuZ with permission to use these non-essential cookies. The website will not work optimally though. Once provided, permission can be withdrawn again (partially or fully), by taking the actions described below. This does not affect the legality of the processing of personal data on the basis of your permission prior to the withdrawal, however.

Your rights concerning your personal data

You have the right to submit a request to ZiuZ to see what personal data belonging to you ZiuZ processes. You also have the right to submit a request to add to, correct, rectify or delete your personal data, or to submit a request to limit the processing of your personal data. You also have the right to have your personal data sent to you and/or to have this transferred to a third party.

 

We would like to expressly draw your attention to your right to object to the processing of your personal data by ZiuZ, insofar as the processing of personal data is based on our legitimate interests.

 

We will meet requests on the basis of the above rights as soon as possible or provide reasons why we cannot (yet) carry out your request. You can send your request to us using the contact details found at the bottom of this Privacy and Cookie Statement. We may ask for additional information in order to determine your identity, if you send us a request.

 

Changes to the Privacy and Cookie Statement

We can adapt this Privacy and Cookie Statement. We do this if the law or our policy changes, for example. We therefore recommend that you regularly consult the Privacy and Cookie Statement again. The last change took place on 19 July 2018.

Processing purposes for personal data and legal basis for processing

ZiuZ POLAR B.V. develops a product to improve the efficiency of the classification of bowel cancer and anomalous polyps by hospitals. During the development project, ZiuZ POLAR requires test material in order to be able to (further) develop artificial intelligence applications which can classify polyps. This concerns health-related data from patients of whom an endoscopic photo has been taken by one of the hospitals affiliated to the POLAR project. ZiuZ Polar receives the data from the hospitals affiliated to the POLAR project. ZiuZ processes the personal data in the context of the POLAR project pursuant to Article 6 paragraph 1 sub f AVG [General Data Protection Regulation] in conjunction with Article 9 paragraph 2 sub j AVG [General Data Protection Regulation].

 

Retention period for personal data and interests
The personal data is processed as long as necessary for said purposes. In principle, the personal data is only processed as long as it is necessary for said (continued) development of the envisaged artificial intelligence applications.

The interests of ZiuZ lie in the development of artificial intelligence applications suitable for classifying polyps. Furthermore, ZiuZ has an interest in the further exploitation of the applications (whether for commercial purposes or otherwise).

 

Request for inspection, and rectification or erasure, of personal data

If your data is listed in our POLAR database, you have the right to request access to, and rectification or erasure of, your personal data or limitation of the processing of the data relating to you, as well as the right to object to processing of this data and the right to data portability, all as applicable. Also, if you are listed in the POLAR database, you have the right to lodge a complaint to the supervisory authority (www.autoriteitpersoonsgegevens.nl).
